This research describes and examines several problems, first regarding how legal
remedies for parties who are aggrieved by the existence of a binding agreement
and whether the legal considerations decided by KPPU on case Number 10 /
KPPU-1/2016 have provided a sense of justice to the parties. This research is a
type of normative law, which is a scientific research system that determines the
truth based on the scientific logic of law from the normative side. Scientific logic in
normative legal research is built on the basis of scientific disciplines and methods
of normative law, namely the science of law whose object is law itself. In this
normative legal investigation, positive legal norms are examined in the form of
statutory regulations, which are related to the title raised. This legal research
focuses on library research, primary legal materials in the form of regulations and
secondary legal materials in the form of books, journals, the internet. The results
of the research show that legal remedies that can be achieved due to a binding
agreement, the injured party can make a report as regulated in the Procedure for
Submitting Reports / Complaints in accordance with the provisions of Law Number
5 of 1999 and the Regulation of the Business Competition Supervisory Commission
Number. 1 of 2019 concerning Procedures for Handling Cases of Monopolistic
Practices and Unfair Business Competition. And in the decision on case Number
10 / KPPU-1/2016, it is known that KPPU decided that PT. Telekomunikasi
Indonesia does not provide justice for the parties because of the losses that must be
borne by the reported party.
