Abstract

Health is a human right that belongs to everyone and everyone deserved health services. Hospitals and doctors are the providers of health services, but sometimes the provided health sevices are not as what the parties expected, sometimes there are mistake made by health workers. This entitled study “Hospital Criminal Liability for Doctors Misdiagnosed of Patients“. The purpose of this research is to find out hospital criminal liability for doctors misdiagnosed of patients. The legal research method that
is used is normative legal research. The results of this research are that hospitals and hospital management can be held asked for criminal liability because hospitals and hospital management have the authority to regulate and command doctors in quiting or prevent doctors from taking actions that are not in accordance with their procedures or competencies, but this authority is not used by hospital
and hospital management. Doctors can also be subjected to criminal sanctions if perpetrate medical practices that are not in accordance with their competencies.
