The development of time brings forth new phenomenon in law of goods so called
virtual property. Virtual property is treated like real property, one of them is can be
traded and the contract recognize anonymity. Until recently, there is no regulation
about virtual property and it is raising an issue. The issues of this research are how
the requirements of validity of traded contract and how the effects of law of
anonymity in the contract.
The research used a normative research form. The research examined rule of law.
Data’s sources in this research are primary and secondary data sources. The data in
this research is obtained literature review. Data analysis is conducted to primary
and secondary law material. Primary law material was analyzed by evaluated the
rule of law. The secondary law material was analyzed by search the legal opinion
that will be used in this research.
The result of this research is show that the validity of traded contract obeys to
paragraph 1320 KUH Perdata. Virtual property’s traded contract not only obey to
paragraph 1320 KUH Perdata but also another regulation that is electronic
information and transaction law. electronic information and transaction law
presupposes the virtual property’s traded contract using electronic system as
required and has been agreed. Virtual property’s traded contract is allowing
anonymity but it is bounded. The effects of law that may appear are the contract is
valid to do or the contract can be cancelled.
