The government considers that it is necessary to improve Law Number 4 of 2009
concerning Mineral and Coal Mining to provide legal certainty in mineral and coal mining
management and exploitation activities for business actors in the mineral and coal sector.
Law No. 3 of 2020 as an improvement to Law Number 4 of 2009 concerning Mineral and
Coal Mining, regulates new content added and eliminates several articles deemed unable
to answer the actual problems and conditions in the implementation of the Mineral and
Coal Mining business, in the process of ratifying many parties assess that the Minerba Law
does not side with the environment and only benefits corporations. the purpose of writing
this thesis is to know the implications of Law no. 3 of 2020 concerning Amendments to Law
Number 4 of 2009 concerning Mineral Mining and of the responsibility of mining
companies for environmental damage. This type of legal research used in this research is
normative legal research that focuses on positive legal norms. The important point that
should be improved is the provisions for reclamation and post-mining which will affect the
environmental damage or not. Based on Article 100 of Law No.4 / 2009, IUP and IUPK
holders are required to provide reclamation guarantee funds and post-mining guarantees,
then if the IUP and IUPK holders do not carry out the reclamation according to the
approved plan, then the minister, governor or regent / mayor in accordance with the
authority can assign a third party to carry out reclamation and post-mining activities with
the guarantee fund.
