Abstract

This study is entitled "Criminal Legal Liability For Nurse Mistakes That Discuss
Professions in Dependent Functions". This research uses normative research
methods that are supported by field studies. Departing from medical actions
performed by nurses in carrying out the dependent function which is part of their
profession. The medical action carried out is part of the delegation of authority
given by the doctor to the nurse. Delegation of authority granted approved
medical measures; installation of infusion and injection for the client. In the
Supreme Court Decision Number 590K / Pid / 2012 that was sentenced for the
error was a doctor. The doctor approves and neglects the death of the client
(patient) by not agreeing to the course of medical actions carried out by the
nurse. How interesting? What to do? What should be thought about? to the
mistakes of nurses who change professions in the dependent function? Based on
the results of research and discussion of the problem of nurses who carry out their
profession in the dependent function, namely medical actions that involve the
installation of infusions and injections that cause the death of the client (patient)
is referred to as the action required in accordance with the provisions in Article
84 of Law Number 36 of 2014 concerning Health workers. The medical nurse's
action does not need to be under the supervision of a doctor because he has
requested the delegation of authority regulated in Article 32 paragraph (3) and
paragraph (4), which explained Law Number 38 of 2014 concerning Nursing.
