Abstract

The research proposal is entitled " resolving of disagreement between military corps
judge advocate (Otmil) and officers hand over the case (Papera) in context of delegation for
case file in Military Court ". The purpose of this research is to know the factors that often
make a difference of opinion between the military corps judge advocate (Otmil) and officers
hand over the case (Papera) in the case of the transfer of the case to the military court and to
know the settlement of disagreements between the military corps judge advocate (Otmil) and
officers hand over the case (Papera) to the military court .The legal writing is a normative
legal writing. The normative legal writing is a research that focus on legal positive law norm
that is formed of the regulation of legislation.In taking the conclusion, a deductive thought
process is used which is the legal reasoning that proceeds from a general proposition whose
the truth has been known which ends in a new conclusion of a special natur. The legal writing
will discussproblems that make dissentient between military corps judge advocate (Otmil) and
officers hand over the case (Papera) are the fulfillment of element in criminal act, difference
in application of artikle,other factor outside non technical, and resolution between
OditurMilitaray and officers hand over the case (Papera) by coordinate to have internal
meeting, if they unable to solve between both of them, so military corps judge advocate
(Otmil) trough officers hand over the case (Papera) ask Main Military Court to resolving.
