Persons with disabilities are a limitation of a person whether physically or mentally or
intellectually. The limitations are caused by birth conginetal or from other factors. Persons with
disabilities also have the same rights and positions as Indonesian Citizens. Persons with
disabilities have rights that must be protected by the community or government, because persons
with disabilities are vulnerable groups whose rights must be maintained. One is the right to get
Education. Education is a very important thing for citizens without exception, because it had been
regulated in the 1945 Constitution of the Republic of Indonesia. Therefore, the role of government
is needed because education for people with disability should get more attention because the needs
of people with disabilities different from other children such as facilities and infrastructure that
support the education process.
In this legal writinhg , the author tries to examine and analyze the Role of Yogyakarta’s City
Government to ensure the Rights of the Children with Disabilities in the Field of Education based
of the 1945 Constitution of the State of the Republic of Indonesia, Law No. 8 of 2016 on Persons
with Disability and Guardian Regulations Municipality of Yogyakarta Number 16 of 2017 as well
as the protection and rights granted by such regulations against children with disabilities.
The type of research that used in this legal writing is the empirical research. The main data source
used in empirical law writing is done directly to the respondents by askd questions directly
(interview) to obtain primary data supported by secondary data consisting of primary legal
materials and secondary legal materials. Based on the results of research and analysis, the
researcher concluded that the role of the Yogyakarta’s city government in an effort to ensure the
rights of children with disabilities in education have not fulfilled the provisions as regulated by the
relevant regulations.
