Abstract

Traditional cultural expression is one part that cannot be separated by copyright. In
order to protect intellectual property, the Indonesian government formed law (No.
28 of year 2014) about copyright. Cembengan ceremony is a culture in Yogyakarta,
Special Region. It conducted by the Madukismo Sugar Factory ahead of the milling
season for the purpose of requesting safety in the milling process. From the
beginning of the factory establish in 1955 until now, that ceremony is still preserved
and developed by the factory and the people living around there. The problem is
whether Cembengan ceremony can be categorized as traditional cultural
expressions and what is the significance of intellectual property protection over it.
This research using empirical method. The result showed that Cembengan
ceremony can be categorized as an expression of traditional culture because it has
fulfilled the elements of traditional cultural expression. Intellectual property
protection for Cembengan ceremony has not been done, because the factory and the
surrounding community only do conservation. This resulted in the absence of
permanent rights for the factory and surrounding communities.
