Currently, many consumers are concerned with ease and efficiency in various things, especially in terms
of land transportation in carrying out daily activities. One of them is by using a motorcycle, the
motorcycle online under the auspices of GO-JEK. With the online motorcycle, then the conventional
motorcycle taxibike to be less competitive because the technology used is different. But actually
motorcycles are not including public motor vehicles but still used for it. The purpose of this paper is to
find out whether motorcycles can be used as public vehicles and how the form of legal protection received
by the parties by using the normative method with deductive way of thinking. The result of the research is
that motorbike enter into individual motor vehicle, but if used in accordance with technical requirements
to carry passengers, transporting goods according to the rules then the motorcycle is also allowed to be
used as an taxibike because there is no firm rule regarding bike ban for public motor vehicles. So both
online motorcycle taxibike and motorcycle conventional can perform their activities as a service provider
as long as they do not violate the requirements in Indonesian law.
