Abstract

This essay titled Legal Analysis Of Use Of Customer Data Obtained By Bank
Parties To Offer Credit Cards From Bank Confidentiality Principles. The
customer data turned out to be insecure and even used by parties who were none
other than the internal side of the bank itself, which then made many customers
worried. This is done by the internal bank opening a system that can access
customer data, then he records and calls through the call center to obtain
customer data that is still active and then asks the bank to update or update the
cellphone number under the pretext of damage to their credit card then after that
the actor sells it to other parties who want to market their products to other
people such as insurance, credit cards and what has recently happened through a
website that is in the form of an e-commerce site made by the buying and selling
agent. This research is aimed to determine whether the provision of customer
data to credit cards and outsourcings is a violation of bank secrecy. The research
method utilized is normative law research by viewing rules concerning of
Legislation – Act No. 7 of the year 1992 Law juncto – Law No. 10 Year 1998
about banking. The results of this research show that customer data is
confidential bank granting object data to the customer's credit card is not always
a violation of the secret banks, because the banks have permission from the
financial services authority in accessingBI checking.
