Abstract

The main aim of this research is to find out what are the obstacles and how to overcome the problem of compensation for the procurement of customary land for customary law communities for the construction of Regional Government Office in Mappi District. The legal research that focuses on positive legal norms in the form of legislation concerning the settlement of compensation for the procurement of customary land for customary law communities to the construction of Regional Government Office in Mappi District. This research uses secondary data. The secondary data consists of primary legal material and secondary legal material. The Regional Government of Mappi Regency has so far been able to solve those problems, especially the problems that has relation to the customary rights of indigenous peoples, at least according to the applicable laws and regulations. In this case the government also has done development in the Regional Government Office in Mappi District. This is regulated accoding to the 1945 Constitution, article 18B verse (2), Article 33 verse (3) and also in Law number 21 of the year 2001 concerning The Special Autonomy for the Papua Province.
