Abstract

ABSTRACT
The study entitled Parameters of Defamation in Article 27 paragraph (3) of the Law on Information and Electronic Transactions analyzes the parameters used to determine an act is said to be defamation in Indonesia. This study aims to find an explanation of any size or limitation that can be used to determine that an act is a crime of defamation. the formulation of the problem from this research is (1) what parameters are used to state that someone has committed insults and / or defamation as referred to in Article 27 paragraph (3) of the Law on Information and Electronic Transactions? Legal research is carried out by normative research methods, which focus on legislation concerning criminal acts of defamation through electronic media and analysis of court decisions related to criminal defamation. Based on legal research methods, it can be concluded that the parameters of defamation of electronic media are nothing but the elements contained in the related article, whereas from what is learned, this study found that the parameters of defamation through electronic media are not only on the elements in related article but also from the norms of decency in society and the material loss suffered by the victim.
