Abstract

"Conflict in Libya 2014 was an second civil war between Khal([a Hafler and General

National Congress, In this conflicts involve both armed groups power, Khalifa Hafler

accused GNC has let terrorist organization to set roots in Libya and funding the

militia rather than the National Army. The method research is used normative

approach, and data Collection is done in two ways which is to study law regulation

which is Geneva Convention 1949 and Additional Protocol 1977, also interview with

humanitarian bodies and united Nations. The Process ofthinking used is deductive, it

started .from general proposition whose truth is known and ended in a specific

conclusion. Research result based on report from books, journal, and interview, in

Benghazi OHCHR report that battle take toll around 2.500 armed groups members

which in category Hors de Combat being ignored and get killed by both side.

Conclusion from this research is both side disobey international humanitarian law in

case ofhelping member 0/armed/orces who suffersfrom battle. "
