Abstract

This essay entitled “the existence of Cultur Criminal Sanction as a Device to resolve

criminal cases” is written due to the local culture law the exist aside from civil law. In

some regions of Indonesia, culture law has stronge influences, an is used by the people

to resolve the criminal cases. The resolution itself is held by cultural institutes, in

which the culturally inappropriate acts will bi given the cultural sanction. Meanwhile,

if the acts is criminally proven, criminal sanction will also given by law enforcments.

Thereby, it is importantto understand the exsistence of cultural sanction in resolving

the criminal case in corresponds to the people’s belief that the cases’s resolution held

by cultural institutes will bring justice and harmony into society.
