Abstract

Consumer finance institutions into new options for the community to meet the
needs that support their daily activities, but many of the debtor is unable to return
objects when their fiduciary breach of fiduciary security object even accidentally
sold another kepihak by the debtor without the knowledge of the creditor. The
problem of this research is how the city of PT Adira Finance Muara Enim
execution against the debtor which eliminates the fiduciary object. The purpose of
research is to know how to PT Adira Finance Muara Enim execution against the
debtor which eliminates the fiduciary object. The research method is empirical
legal research, the research by approaching the problem as primary sources are
sources through interviews and observations. The results showed that Pt.Adira
Muara Enim carry out the execution against the debtor which eliminates the
fiduciary object by filing outside the jurisdiction of the District Court of Muara
Enim, and reporting, and requesting assistance in execution to the police station
outside the police station Muara Enim.
