Abstract

This thesis explained the role of the International Investigating Body to enforce
Humanitarian Law in armed conflicts between Israel and Palestine and how is the
effectiveness of the Investigation body in enforcing humanitarian law. This research is
normative legal research that focuses on positive legal norms. The method used in
analyzing data is qualitative descriptive. The thesis used deductive methods to find out
the role of the investigating body to enforce humanitarian law in armed conflicts between
Israel and Palestine. This thesis concludes the investigation body investigate all
violations occurring in an armed conflict based on appropriate procedures, including
providing necessary recommendations aimed not only at parties in conflict but also for
the community international. In addition, because the investigation body's final report is
a public report, it can contribute to the recording of historical events, strengthen calls for
violators of humanitarian law as well as promote the implementation of
recommendations. However, there are also several obstacles in following up on the
report on the results of the investigation, making the report on the results of the
investigation not legally binding but only limited to the report of the investigation results
which contain facts and evidence regarding the violations that occurred. While the
mechanism of its own responsibility is only described in the recommendations.
