Abstract

The military is a tool of the state, which served to maintain, protect and
maintain the sovereignty of the country. In the writing of this law the author
writing the headline of the sanctions law against members of the military who
commit acts of maltreatment against civilians. The method used is research the
law already that the normative, where data obtained from the law primary in the
form of legislation, the legal secondary books, the opinion of the law, and the
results of research. The gathering data carried out by the method study library and
interview.
Then on the conclusion it is a response to the arrangement issues
contained in this law, where the form of sanctions against members of the military
abuse against civilians is in the form of imprisonment for 4 (four) months with a
trial period for 6 (six) months, with orders to crime does not have to do except
when the then there was a verdict that determines the other. The consideration of
the judge in the imposition of sanctions against the army did the maltreatment of
civilians is a judge in the more pointed out on aspects of development is not
merely to punish, as the military is also a human being who may also be affected
by emotional factors. By dropping the sentence based on aspects of development
and educators which is expected to revive the perpetrators.
