Indonesia has regulation to protect the cultural heritage in every object of heritage, the
problem is how to solve about ilegal trading of object cultural heritage on the
international trading. The formulation of the legal matter of this legal writing is the
implementation of a policy of prohibition of sale objects of cultural heritage by
Indonesia that it doesn’t violate with the principle of the WTO agreement in GATT
especially. This legal writing aims to know the implemenation of the validity of the law
number 11/2010 about Heritage against the selling of objects of cultural heritages have
based baseic law provisions that protect that does'nt conflict with the the principles of
free trade by WTO based in General exceptions 20 GATT 1994. The method that used
to this legal writing is normative legal research. The results from the data analyzes it
could be concluded that Indonesia actually has hard regulation for Cultural Heritage
in Undang-Undang number 10/2011 about protection of culut. If there something
happen about illegal trading for cultural heritage, it must be solved by thr government
before. International trading can give some regulation for exception of that trading.
General Exception is the answer for that problem about ilegal trading of cultural
heritage, the reason is every trading must be has important reason like knowledge,
protect or etc. This can be useful for legal writing development of the science of law in
particular Internasional law, commercial law, International trade law and in relation
to the protection of items of cultural heritage on the basis of legislation and instrument
apllicable International.
