So many private property rights in West Manggarai Regency that have problem certificate
that is the issuance of two certificates in one plot of land of ownership, before the certificate
is issued must be preceded by the collection and processing of physical data and its evidence
and bookkeeping as stipulated in article 12 of Government Regulation Number 24 Year 1997
on land registration. The Land Affairs Office of West Manggarai Regency is expected to
execute an order of this provision, so as not to cause a dispute resulting in the possession of
multiple certificates.This research is to know and analyze the occurrence of double issuance
in land ownership registration process and to know the function of Land Office of Manggarai
Regency in preventing the issuance of double certificate in registration process of land
ownership. This research uses empirical law research method. Based on the result of the
research and the case which has been described can be drawn two conclusions as follows:
first conclusion of the community doing the buying and selling process and licensing the land
of other people's property by not knowing the land and landowners of Land Office which has
been issued two same certificate at one plot of land of ownership, the conclusion of the
second implementation of the function of the land office in preventing the occurrence of
double certificate so far still hold a degree of complaint services that aims to overcome the
occurrence of disputes. Suggestions that the authors provide in an effort to prevent the
emergence of a double certificate for the Land Office of West Manggarai Regency should the
officers of the Land Office more thorough and careful in conducting the process of
registration and issuance of certificates on land ownership and for the community to ensure
the origin of land ownership before buying and selling process on the property right.
