This research is conducted to answer the problem arises, namely, what is the comparison of threat delict according to Suku Dayak Desa in Dusun Tapang Sambas’ adat penal law and Article 335 Paragraph (1) Number 1 of Indonesian Penal Code. This research was conducted using normative legal research, with secondary legal data as the main source and primary legal data as the supporting source. The topic in this paper was obtained when the writer was doing Kuliah Kerja Nyata in Dusun Tapang Sambas, Kecamatan Sekadau Hilir, Kabupaten Sekadau, Kalimantan Barat. After the data collected is analysed, it can be concluded that there are two differences. The first one is, the fine given to the perpetrator is larger in sum if it is compared to the sanction determined in Article 335 Paragraph (1) Number 1 of Indonesian Penal Code. But, the people of Suku Dayak Desa in Dusun Tapang Sambas still decided to use their adat penal law to sort out the case. The other differences are, the adat penal law given to the perpetrator is in accordance with the purpose of restorative justice system. On the other hand, penal sanction can encourage secondary victimisation because of the social stigma towards people who had been a prisoner.
