Abstract

Counterfeiting of counterfeit goods is an act of abuse against an identical
trademark that infringes the rights of the trademark holder of intellectual property
rights. In addition to breaking the law, the phenomenon of rampant piracy is very
destructive for the wider community. In Law No. 15 of 2001 on Marks, Penalty
charges to be imposed on counterfeiters may be in the form of imprisonment,
imprisonment and fines. This paper aims to find out how Law Enforcement Against the
Trade of Counterfeit Goods (Case Study in Beringharjo Market) ". The method of
writing this law is Normative Law Research. Normative legal research is a legal
research conducted by examining the library material which is secondary data, which
focuses on positive legal norms in the form of legislation. The result of this thesis is
the trade of fake brand goods in Beringharjo Market can continue to occur because
there is no report to security and government apparatuses and the need for law
enforcement against the trademark of counterfeit merchandise in the Beringharjo
Market as opposed to three legal compliance objectives of certainty, usefulness and
fairness.
