The title of this thesis is “JURIDICAL OBSERVATION OF REGULATION OF THE MINISTER
OF AGRICULTURE NO.61/2016 FROM THE STANDPOINT OF BUSINESS COMPETITION”
discusses about if there is any potential of Unfair Business Competition caused by the Minister of
Agriculture Regulation No.61/2016. This thesis aims to determine whether the Regulation of the
Minister of Agriculture has the potential to create unfair business competition based on the case of
the price of consumption eggs that fell below the cost of sales on the market. With this thesis
writing, the writer try to observe what is the the problem in the regulation of Minister of
Agriculture No.61/2016 and the impact for the businessman at the market. The type of research in
this thesis is a normative legal research. Normative legal research is a research to examine the
implementation of positive law. From the standpoint of Business Competition, it can be concluded
that the Regulation of The Minister of Agriculture has the potential to create Unfair Business
Competition due to unregulated consumption eggs and their distribution also does not regulate
about the handling of the Hatching Egg that not hatched. Unfair business competition caused by
the Regulation of the Minister of Agriculture is seen from the existence of cases caused by the
activities of anti-competition act, namely Monopoly.
