This thesis is entitled “Juridical Review towards Work from Dubsmash Application in the Copyrights
Perspective”. Issues in this thesis are: whether works from dubsmash application in form of video is works
protected by the copyrights or not; and whether works created from dubsmash application violate the
copyrights or not. The objective of this thesis is to analyze that works from dubsmash application protected
by copyrights or not; and to understand whether the works form dubsmash application violate law of
copyrights or not. The research method is normative. The result from this research are that works from
dubsmash application took form as lip-sync video in 15-20 seconds duration. Works from dubsmash
application is not a creation because according to the Law number 28 of 2014 about Copyrights, in article 1
section 3, creation from dubsmash application not included to elements or requirements to be considered as
creation. As for article 40 about creation which protected, creation from dubsmash application took form as
video violates law of copyrights that is moral rights. It’s because in the video, found audio clip from music or
film of other people, or maybe voice recording from someone else. As for Law no. 28 of 2014 about
Copyrights, creation from dubsmash application violates article 5 section 1 subsection e because of
mutilation from others creation or work.
